These General Conditions (hereinafter the “GC”) regulate the access and use of the website www.barcelo.com/experiences, the property of Barceló Gestión Hotelera, S.L.
1. Identification of the parties
The party of the first part, Barceló Gestión Hotelera, S.L. (hereafter “Barceló”), whose registered office is at C/ Rover Motta 27, 07006, Palma de Mallorca, Reservations Centre number CR/235 and CIF B-07918287. Contact telephone number 971 771 700 and email address experiences@barcelo.com.
And the party of the other part, the physical person (hereinafter “the User”) who accesses the website to obtain information and to reserve experiences offered on the Website.
The User declares that s/he is of adult age (i.e. over 18 years), and has the legal capacity to reserve experiences through the website in accordance with the present GC, which s/he understands in its entirety. In the case of a contract being entered into by a person not of adult age, Barceló accepts no responsibility whatsoever, with the person him/herself, his/her parents or his/her guardians accepting any expenses incurred.
In a case where the User makes use of a payment method of which s/he is not the direct holder, s/he guarantees that s/he has the authorisation of the direct holder of the payment method to make the reservation of the experience.
2. Object and acceptance
Through the present website, Barceló offers Users a service to reserve experiences in various destinations around the world.
Any reservation made by the User through our website implies the acceptance of the present GC. The User confirms understanding of the present GC before making the reservation.
Barceló reserves the right to amend the GC by publishing the new general conditions on the same website.
The temporary non-application of any of the clauses of the GC will not imply the cancellation of the remaining clauses.
Barceló advises that the experiences are supplied by third-party partners (hereinafter, the “Suppliers”) and for this reason, Barceló acts via the website as a reservation centre for experiences provided by the Suppliers in different parts of the world.
3. Reservation of Experiences via the website
The reservation of an experience via the website must be made in accordance with the process described below.
1. The User sees the experience on the website
2. S/he completes the form to request the reservation and submits it
3. Below, two possible processes are described, depending on the type of experience: those that do not require prior confirmation of availability to BHG by the intermediary, and those that do:
a. Requests that do not require confirmation by the intermediary. The process consists of the following steps:
- Both the intermediary and the BHG receive the request for the reservation.
- BHG sends confirmation of availability directly to the customer, together with a link to access the virtual POS owned by the intermediary.
- The intermediary sends BHG confirmation of the customer’s payment.
- BHG sends confirmation of the reservation to the customer.
b. Requests that require confirmation by the intermediary. The process consists of the following steps:
- Both the intermediary and the BHG receive the request for the reservation.
- The intermediary sends confirmation of availability to BHG.
- BHG sends confirmation of availability to the customer, together with a link to access the virtual POS owned by the intermediary.
- The customer makes the payment.
- The intermediary sends BHG confirmation of the customer’s payment.
- BHG sends confirmation of the reservation to the customer.
4. Prices and method of payment
The price is shown in euros and will be the price set by Barceló at the point when the User makes the reservation.
The User commits to pay for the reserved experience using one of the following methods of payment outlined below:
- Debit Cards (Visa Electron and Maestro) or Credit Cards (Visa, Master Card or American Express), via the payment platform made available to the customer after s/he requests the reservation.
The act of requesting a reservation implies commitment by the User to authorise the charge on the credit card supplied. In a case where it is not possible to charge the credit card (charge rejected), the User accepts that Barceló will not process the reservation.
Once the payment has been made, Barceló will send the User the documentation relating to the reservation of the experience either by sending it to his/her email address if the payment has been made via the website, or by delivering it to the reception of the hotel where the payment is to be made.
5. Right to cancel
This is the User’s power to cancel the reservation via the website. The User may at any time cancel the requested reservation, and has the right to a refund of the payments made; s/he must however compensate the organiser of the experience according to the amounts set out below, unless the resolution takes place due to force majeure:
- The User will pay a penalty of 5% of the cost of the experience if the cancellation occurs more than ten days and fewer than fifteen days before the date when the experience would take place, 15% if the cancellation occurs between three and ten days before the date when the experience would take place, and 25% if the cancellation occurs within forty-eight hours of the date when the experience would take place.
- In cases where the experience is subject to special contractual conditions (such as the purchase of tickets for a museum or a show, etc.), the User shall assume responsibility for any expenses arising from the cancellation of the said purchases.
6. General conditions of the Experiences
All reservations of experiences made via the website shall be subject to the conditions set out as follows:
- All information (for example, dates, schedules, pick-up points, duration, etc.) about experiences offered on the website has been provided by third-party suppliers; therefore, they are responsible for any error in relation to the information they have provided with regard to the experiences.
Users may amend the information they have provided on the reservation of the experience, provided that the nature of the information permits it. In order to make the amendment, the customer must send an email to the following address: experiences@barcelo.com.
- Insofar as Barceló acts as a reservation centre, and since the experiences are offered by independent contractors, Barceló is not responsible for:
– Errors, omissions or failure to provide on the part of suppliers of experiences.
– Personal injury, death, material damage, or theft suffered by the User during the course of the experience.
– Cancellation of the experience, whether due to cancellation, overbooking or force majeure.
– Cases where the supplier of the experience does not allow the User to undertake the experience because the User is unable to produce the required voucher.

8. Copyright, trademarks, software rights
All content of this website (including text, trademarks, graphics, logos, icons, buttons, images and software) are the property of Barceló or its content providers, and are therefore protected by national and international regulations on industrial and intellectual property.
The selection, reproduction, arrangement, programming, design and assembly of the entire content of the website is the exclusive property of Barceló and is thus protected by national and international regulations on industrial and intellectual property. All the software used on the website is the exclusive property of Barceló or its software providers, and is protected by national and international regulations on industrial and intellectual property.
Any use of the website content or photographs (including reproduction, modification, distribution, transmission, subsequent publication, exhibition, or partial or total representation) is strictly prohibited without the express permission of Barceló or its suppliers.
9. General information, legislation and jurisdiction
Barceló reserves the right to amend, limit or cancel these GC at any time.
In all cases, the conditions in force at the time when the User submitted the reservation will apply, or the subsequent conditions if these are more favourable to the consumer.
If any clause in these conditions is declared null and void, totally or partially, the remaining general conditions remain in force, being such that the part affected will be deemed not established.
Barceló reserves the right to deny or withdraw access to the website at any time (and without prior notice) to Users who do not comply with these GC, or who make inappropriate use of the services and content published on the said website.
The present GC are subject to Spanish law. For the resolution of any dispute, the parties agree to submit to the courts and tribunals of the home country of the User, waiving their right to any other jurisdiction.
